that is worn out, and you want
to sand and re-stain the decking surface then you are not
required to apply. This section
also applies to damaged siding
pieces, paint touch-up, and
any other small-scale projects
that restores a portion of your
previously approved property
to its original state. Where a
lot of folks go wrong is by misinterpreting Maintenance and
Repair for Replacement, which
is up next!
Section 3.01b defines “Replacement” as “intended to
construct a new element in
place of an approved structural feature to achieve the
same purpose as the original
construction.” This means, for
example, if you re-build your
rotten deck in the exact same
previously approved dimensions, materials, colors, etc.
then you have a replacement
project on your hands.
This section also notes that
replacement MAY require administrative or design committee review subject to Section
6. So, let’s head to Table 1 in
Section 6 and see what kinds
of replacement projects require
design review and which don’t.
Looking at Section 6, Table
1: Development Applications
by Project and Review Type;
each one of the types of projects listed in Section 3 is represented here. Additionally,
each section has subsections or
options. Finally, each subsection has columns to the right
side with information: Review
Type, Manual Section, Building Permit Fee/Timeline, and
Review Fee. In the aforementioned example, a rotten deck
replacement, just flip on over
to the Project Type (Category)
“Decks” and you will notice (3)
subsections; the first of which is
“Deck Replacement.” A quick
scan to the right indicates a
Type 1 Review, N/A Building Permit Fee/Timeline, and
a $100 Review Fee. This is a
clear indication that you need
to submit an application for
design review.
Similarly, replacement lighting under Section 3.19 has the
same requirements. Alternatively, Driveway repaving under
Section 3.04 does not require a
Building Permit Fee nor a review fee but is subject to a Type
1 review. Therefore, a cost-free
application should be submitted and will be put on record so
that the replacement date is on
file for the future, where your
real-estate agent might want to
know that information to aid in
the sale of your home.
Double check your house
plans
In conclusion, before starting any project it is important
to acquire the previously approved record plans for your
property from the Community
Development Department, for
a few reasons.
First, if you are Repairing &
Maintaining and/or Replacing you can be ensured that
what is currently in place was
approved. Unfortunately, just
because something was there
when you bought the house
doesn’t mean it got approved,
which is a requirement.
Secondly, if you are planning
on adding something new or
changing something that currently exists, you can get your
hands on a set of plans to alter
and illustrate your proposal
and attach it to your application which might save you the
expense of hiring a designer or
architect.
Lastly, when in doubt ask the
Community Development Department, not your contractor,
not your neighbor, not anyone
other than SROA staff working
in the Community Development Department. We are here
